Thousands upon thousands of foreign-born individuals are imprisoned in United States detention facilities across the country without the ability to pay for bail or having bail. A vast number of individuals in the immigrations system are people who have committed no crimes, but have been charged with unlawful presence in the United States, or having violated their temporary visa or permanent resident status. These individuals’ families are often forced to live with relatives or apply for welfare for support while the imprisoned wait for a hearing date before Immigration Judges or for their appeals to receive a decision by the Board of Immigration Appeals or the Federal Courts.

Although the individuals detained in these detention facilities have even less legal rights than individuals accused of crimes (despite their legal status), they do still have rights and must take advantage of them.
